Terms of use

This document also exists in French. In the event of any discrepancy between the two versions, the French version prevails.

Purpose

These terms govern access to the Muzau service and its use. Creating an account or using the service constitutes acceptance.

They are read together with two other documents, which form a single contractual set with them: the terms of sale, which govern subscriptions, credits and billing, and the data processing annex, which governs what we do with your own customers' data. On a question of sale, the terms of sale prevail; on a question of data, the annex.

Who publishes the service

Muzau is published by Arthur Osstyn EI, a sole trader trading under the name O2S, SIREN 900 494 048. Contact: contact@muzau.fr. Full details are in the legal notice.

What the service is

Muzau lets you create autonomous software agents and run them. You describe what you want to delegate; the agent reads, decides and acts by your rules, within the limits you set for it. Every one of its actions is written into a log you can consult.

The service is reserved for businesses acting for the purposes of their activity. It is not aimed at consumers.

Muzau is an artificial intelligence system within the meaning of European regulation 2024/1689: we are its provider, and you are its deployer, meaning the party that uses it under its own authority.

A free plan, and paid plans

The service is offered under several plans. The free plan lets you find out what the agents do: it stays free, and nothing is billed to you until you have taken out a paid plan yourself.

Subscriptions, credits, prices, billing and cancellation are governed by the terms of sale.

The service keeps evolving: features may be added, changed or removed. We tell you about substantial changes, and since your subscription is monthly, you can end it if they do not suit you.

Your account

An account is opened for a company. Your credentials are personal: you keep them confidential and answer for what is done from your account. Tell us without delay if you suspect illegitimate access.

Connecting your tools

You may connect your own tools to the service: calendar, spreadsheets, files. In doing so, you authorise Muzau to access them strictly within the limits of the permissions you grant, and for the sole purposes of the service you asked for.

You can withdraw that access at any time, from Muzau or from the account of the service concerned. The detail of the data concerned appears in our privacy policy.

What stays your responsibility

It is you who define your agents' rules, who approve what has to be approved, and who remain responsible for the messages sent and the commitments made in your name.

You make sure that the content and data you entrust to the service are lawful, that you have the right to process them, and that the people your agents contact may legitimately be contacted.

For the messages your agents send to your own contacts, you are the controller of their data and we act on your behalf: it is for you to have a legal basis for contacting them, and for us to process only on your instructions. The exact split of roles is set out in the data processing annex.

What is not allowed

Using the service for unlawful or deceptive purposes; sending unsolicited messages in bulk; getting around or disabling the platform's guardrails; attempting to access another customer's data; reselling, renting out or decompiling the service.

Also excluded are uses falling under Annex III of the European regulation on artificial intelligence: screening job applications, evaluating employees, deciding on the granting of credit, gating access to an essential service. These are subject to a specific regime that the service does not cover today.

A breach may lead to suspension of the account, after notice except in an emergency or where the law requires otherwise.

What belongs to whom

The platform, its code, its brand and the agents remain the property of its publisher: an agent you configure is part of the platform, you have the use of it for the term of the contract, not ownership. Your data and your content, however, remain yours: you grant us only the right to host and process them as far as running the service requires.

Your personal data

It is processed as described in our privacy policy, which forms an integral part of these terms.

Limits of the service

Muzau undertakes to use reasonable means to provide a reliable service, without guaranteeing that it will be free of error or interruption.

The service relies on language models: what they produce may be inaccurate. That is the whole point of the safeguards, the human approvals and the log: use them. To the extent the law allows, we cannot be held liable for decisions taken on the basis of an output of the service without that supervision.

If you have taken out a paid plan, the liability cap and exclusions are those of the terms of sale.

Term and termination

You may stop using the service at any time. Deletion of your account and your data can be requested from your account settings, or at contact@muzau.fr.

If you have taken out a paid plan, cancelling it follows the terms of sale: cancellable each month, taking effect at the end of the current month.

Changes to these terms

These terms may be modified. Any substantial change will be signalled to you before it takes effect; the date in force appears at the top of this page.

Governing law

These terms are governed by French law. In the event of a dispute, we will first seek an amicable solution; failing that, the French courts will have jurisdiction.
